These Terms & Conditions apply to purchases made through the Moeks Amsterdam website. By placing an order through our website, you agree to these Terms & Conditions. If you are a consumer, mandatory rights granted to you under applicable consumer protection law always take precedence over these Terms & Conditions.

2. Products and Product Information
We make every effort to ensure that product descriptions, photographs, colours, sizes and other product information are accurate and up to date.
Colours may appear slightly different depending on your screen or device.
If a product is unavailable after you have placed an order, we will inform you as soon as possible and, where applicable, refund any amount already paid for that product.
3. Prices
All prices shown on our website are in euros and include applicable VAT, unless stated otherwise.
Shipping costs and any other unavoidable additional costs are shown clearly before you complete your order.
We reserve the right to correct obvious pricing or product information errors. If an obvious error affects an order you have placed, we will inform you as soon as possible.
4. Placing an Order
By placing an order, you submit an offer to purchase the products in your order.
After placing your order, you will receive an order confirmation by email. This confirmation confirms that we have received your order; it does not necessarily mean that the order has been accepted if we are unable to fulfil it.
If we are unable to accept your order, for example because a product is unavailable or there is an obvious error in the product information or price, we will inform you as soon as reasonably possible and refund any amount already paid for the affected order.
5. Payment
Payment must be completed using one of the payment methods made available during checkout.
Payment information is processed through the relevant payment service provider. We do not have access to your full payment card details.
6. Shipping and Delivery
Orders within the Netherlands are normally processed and dispatched on the next business day.
Delivery within the Netherlands costs €6.95. Depending on the destination and our shipping arrangements, orders may be delivered using DHL or PostNL.
For deliveries to other European countries and destinations outside Europe, delivery normally takes approximately 5–8 business days, although actual delivery times may vary depending on the destination, carrier and circumstances outside our control.
Shipping costs for destinations outside the Netherlands depend on the destination country and are shown before you complete your order.
We will make reasonable efforts to deliver your order within the stated or agreed delivery period. If a delivery is significantly delayed, you retain any rights you may have under applicable consumer law.
7. Right of Withdrawal
If you are a consumer in the European Economic Area, you generally have a statutory right to withdraw from your purchase within 14 days without giving a reason.
The withdrawal period normally starts on the day you, or a person designated by you, receives the goods.
You can exercise your right of withdrawal using our online withdrawal function behind the login of your account, where available, or by contacting us at info@moeksamsterdam.com.
You do not have to provide a reason for exercising your right of withdrawal.

Nothing in these Terms & Conditions limits any mandatory statutory withdrawal rights.
8. Returns
If you exercise your right of withdrawal, you must send the goods back within the applicable statutory period.

Please follow the return instructions provided with your order or on our website.
You may inspect and try on clothing to the extent reasonably necessary to determine its nature, characteristics and fit, as you would be able to do in a physical store.
You are responsible for any reduction in the value of the goods resulting from handling beyond what is necessary to determine their nature, characteristics and functioning.

9. Exchanges
We do not offer direct exchanges.
If you would like a different size, colour or product, you can return the original item in accordance with our return policy and place a new order for the desired item.
Your statutory rights remain unaffected.
10. Faulty, Damaged or Incorrect Products
If you receive a product that is faulty, damaged, or different from what you ordered, please contact us at info@moeksamsterdam.com as soon as reasonably possible and provide your order number and, where useful, photographs of the issue.
Nothing in these Terms & Conditions affects your statutory rights concerning defective or non-conforming products.
11. Legal Guarantee and Consumer Rights
We are legally responsible for ensuring that products supplied to consumers comply with the purchase agreement and applicable mandatory consumer protection laws.
Your statutory rights, including applicable conformity and legal guarantee rights, cannot be excluded or reduced by these Terms & Conditions.
12. Intellectual Property
All content on the Moeks Amsterdam website, including text, photographs, logos, graphics, designs and other materials, is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify or use our content for commercial purposes without our prior written permission, unless permitted by law.
13. Website Use
You agree to use the Moeks Amsterdam website lawfully and responsibly.
You must not use the website for unlawful purposes, attempt to interfere with its operation, or knowingly introduce harmful software or other malicious content.

To the extent permitted by law, we are not responsible for losses caused by circumstances outside our reasonable control.
17. Events Beyond Our Reasonable Control
We will not be responsible for delays or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, such as serious disruptions to transport, natural disasters, major technical failures or other events that could not reasonably have been prevented.
This does not affect your mandatory statutory consumer rights.

We may update these Terms & Conditions from time to time, for example when our business or applicable legislation changes.
The version applicable to your purchase is the version that was made available to you before you placed your order.
